These Terms of Service (“Terms”) govern your access to and use of the website located at fxbynature.com (the “Site”) and your purchase of any products offered on the Site. The Site is owned and operated by Functional Nature, LLC, a limited liability company organized under the laws of the State of Wyoming (“Functional Nature,” “we,” “us,” or “our”).

Please read these Terms carefully. By accessing or using the Site, or by placing an order, you agree to be bound by these Terms and by all policies incorporated by reference, including our Legal Notice & Disclaimer, Return & Refund Policy, and Shipping Policy. If you do not agree to these Terms, please do not use the Site or purchase our products.

1. Agreement to these Terms

By accessing the Site, creating an account, or placing an order, you confirm that you have read, understood, and agree to be bound by these Terms, together with all policies referenced within them. These Terms constitute a legally binding agreement between you and Functional Nature. We may update these Terms from time to time as described in the “Changes to these Terms” section below.

2. Eligibility

You must be at least 18 years of age to purchase products from the Site. By placing an order, you represent and warrant that you are at least 18 years old, that you are able to form a legally binding contract, and that all information you provide is accurate and complete. If you are using the Site on behalf of another person or entity, you represent that you are authorized to accept these Terms on their behalf.

3. Our products and important health disclaimers

Our products are dietary supplements. They are not drugs and are not intended to diagnose, treat, cure, or prevent any disease.

These statements have not been evaluated by the Food and Drug Administration. This product is not intended to diagnose, treat, cure, or prevent any disease.†

Any statements on the Site regarding the way an ingredient or product may support the body describe general structure and function only, and are not claims to treat, cure, or prevent any health condition. Information provided on the Site is for general informational and educational purposes only and is not medical advice. It is not a substitute for advice from your physician or other qualified healthcare provider.

You should consult your physician or healthcare provider before using our products, particularly if you are pregnant, nursing, trying to become pregnant, have a known or suspected medical condition, or are taking any medication. Our products contain collagen peptides derived from bovine (cattle) sources and are not suitable for vegans or vegetarians. Manufactured in a facility that also processes milk. Please review the full ingredient list and label before use, and discontinue use if you experience any adverse reaction.

4. Product information, pricing, and availability

We work to ensure that product descriptions, images, ingredient information, and pricing on the Site are accurate and current. However, we do not warrant that all content is error-free, complete, or up to date. Colors and images may vary depending on your device.

All prices are listed in U.S. dollars and are subject to change without notice. In the event a product is listed at an incorrect price or with incorrect information due to a typographical, pricing, or other error, we reserve the right to cancel or refuse any order placed for that product, whether or not the order has been confirmed and your payment method charged. If your payment method has already been charged and we cancel your order, we will issue a refund in the amount of the charge.

All products are offered subject to availability. We reserve the right to limit quantities, discontinue any product, or refuse or cancel any order at our discretion.

5. Orders and payment

When you place an order, you are making an offer to purchase the products in your cart subject to these Terms. We reserve the right to accept or decline your order for any lawful reason, including suspected fraud, errors in pricing or product information, or limitations on quantities available.

By providing a payment method, you represent and warrant that you are authorized to use it and you authorize us to charge your payment method for the total amount of your order, including any applicable taxes. If your payment cannot be processed, your order may be suspended or cancelled.

You are responsible for any applicable sales or use taxes associated with your order, which will be calculated and displayed where required.

6. Shipping, cancellations, returns, and refunds

Shipping timelines, coverage, and costs are described in our Shipping Policy. Order cancellations, our 60-day money-back guarantee, and the handling of damaged, incorrect, or lost orders are described in our Return & Refund Policy. Both policies are incorporated into these Terms by reference. By placing an order, you agree to the terms of those policies.

7. Intellectual property

All content on the Site — including text, graphics, logos, images, product names, brand names, the "FXN", “FX by Nature” and “Functional Nature” marks, page design, and the compilation of all content — is the property of Functional Nature, LLC or its licensors and is protected by United States and international intellectual property laws.

You may access and use the Site for your personal, non-commercial use only. You may not copy, reproduce, republish, distribute, modify, or create derivative works from any part of the Site, or use any of our trademarks, without our prior written permission.

8. Customer reviews, testimonials, and submissions

The Site may allow you to submit reviews, testimonials, comments, photographs, or other content (“Submissions”). By making a Submission, you grant Functional Nature a perpetual, irrevocable, worldwide, royalty-free, non-exclusive, and fully sublicensable right and license to use, reproduce, modify, adapt, publish, translate, distribute, and display that Submission in any media, in connection with our business and marketing, without compensation to you.

You represent and warrant that your Submission is your own original content, is truthful, and reflects your honest experience and opinion; that it does not infringe the rights of any third party; and that it does not contain unlawful, misleading, defamatory, obscene, or otherwise objectionable material. You agree not to submit any content that describes our products as diagnosing, treating, curing, or preventing any disease or medical condition, or that makes any health claim about our products that is not truthful and substantiated.

We are not obligated to publish any Submission, and we reserve the right to review, edit, decline to post, or remove any Submission at any time and for any reason, in our sole discretion, including to comply with applicable law. Reviews and testimonials reflect the individual experiences of the customers who submitted them; individual results may vary and are not guaranteed.

9. Prohibited uses

You agree not to use the Site for any unlawful purpose or in any way that could damage, disable, or impair the Site. Without limitation, you agree not to: attempt to gain unauthorized access to any part of the Site or its systems; use the Site to transmit any harmful code, spam, or fraudulent content; scrape, data-mine, or use automated means to collect information from the Site; impersonate any person or entity; or use the Site in any manner that violates any applicable law or regulation.

Any statements about our products relate to their general structure and function and are not a guarantee of any specific outcome. Individual results may vary.

12. Assumption of risk

You acknowledge that dietary supplements affect individuals differently and that it is your responsibility to determine whether a product is appropriate for you. You agree that you are voluntarily using our products with knowledge of the health disclaimers set out in these Terms and in our Legal Notice & Disclaimer, and that you assume full responsibility for consulting a qualified healthcare provider before use, reviewing the ingredient list for allergens or sensitivities, and using the product only as directed.

13. Limitation of liability

To the fullest extent permitted by law, Functional Nature, LLC, and its members, managers, employees, agents, and suppliers shall not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, including loss of profits, data, goodwill, or other intangible losses, arising out of or relating to your use of the Site or any products purchased through it, whether based in contract, tort, strict liability, or any other legal theory, even if we have been advised of the possibility of such damages.

To the fullest extent permitted by law, our total aggregate liability for any claim arising out of or relating to the Site or any product shall not exceed the amount you actually paid for the product giving rise to the claim. Some jurisdictions do not allow the exclusion or limitation of certain damages, so some of the above limitations may not apply to you.

14. Indemnification

You agree to indemnify, defend, and hold harmless Functional Nature, LLC, and its members, managers, employees, and agents from and against any claims, liabilities, damages, losses, and expenses, including reasonable attorneys’ fees, arising out of or in any way connected with your use of the Site, your Submissions, your violation of these Terms, or your violation of any rights of any third party or any applicable law.

15. Governing law and dispute resolution

These Terms and any dispute arising out of or relating to them or to your use of the Site or our products are governed by the laws of the State of Wyoming, without regard to its conflict-of-law principles. You agree that any such dispute shall be brought exclusively in the state or federal courts located in the State of Wyoming, and you consent to the personal jurisdiction of those courts.

To the fullest extent permitted by law, you and Functional Nature each waive any right to a trial by jury, and each agree that any dispute will be brought in an individual capacity only, and not as a plaintiff or class member in any purported class, collective, or representative proceeding.

16. Changes to these Terms

We may revise these Terms from time to time. The most current version will always be posted on the Site with the “Last updated” date shown at the top. Changes are effective when posted. Your continued use of the Site or placement of an order after any change means you accept the revised Terms. We encourage you to review these Terms periodically.

17. Severability and waiver

If any provision of these Terms is found to be unlawful, void, or unenforceable, that provision will be severed and the remaining provisions will remain in full force and effect. Our failure to enforce any right or provision of these Terms will not be considered a waiver of that right or provision.

18. Entire agreement

These Terms, together with our Legal Notice & Disclaimer, Return & Refund Policy, Shipping Policy, and any other policies posted on the Site, constitute the entire agreement between you and Functional Nature regarding your use of the Site and supersede any prior agreements.
